1. Provider

2. What you are buying

One purchase buys one defined digital service, performed immediately: the on-stream timer is extended by exactly 60 seconds, and the display name you entered is shown in the livestream for approximately five seconds.

Nothing else is included. There is no account, no membership, no ownership of anything, and no promise that any particular number of people will see your name.

3. How the contract is formed

Clicking the save button and completing payment on the payment page is your binding offer. The contract is formed when the payment is confirmed and the time is credited. The service is then performed within seconds.

4. Price and payment

The price is shown on the save page before purchase and includes VAT where applicable. Payment is processed by Stripe. We never receive or store your card details.

5. Limits

The timer has a maximum. When a full minute no longer fits below that maximum, no purchase is possible and the site says so. If the timer reaches zero, that Bob is permanently dead. There is no revival, and no purchase can undo it.

The starting time, the maximum and the length of one save are set per generation and are shown on the site. They may differ between one Bob and the next.

6. Display names and moderation

Names are limited to 40 characters and are checked automatically before they are shown. If a name is rejected, the payment remains valid, the minute is still credited, and the display reads “anonymous”. There is no entitlement to have a particular name shown, and no refund on that basis.

We may show any name as “anonymous” at our discretion, including retroactively.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. Because this service is performed immediately and in full, that right expires early — but only if you expressly consent to immediate performance and confirm that you thereby lose the right of withdrawal. That is what the checkbox on the save page is for. Without it, no purchase is possible.

Widerrufsbelehrung

Widerrufsrecht. Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsschlusses.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (404 Goods UG (haftungsbeschränkt), Gärtnerstraße 20, 10245 Berlin, Deutschland, Telefon +49 30 35517092, E-Mail 404goods@gmail.com) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs. Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

Vorzeitiges Erlöschen des Widerrufsrechts. Ihr Widerrufsrecht erlischt bei einem Vertrag über die Erbringung von Dienstleistungen, wenn wir die Dienstleistung vollständig erbracht haben und mit der Ausführung erst begonnen haben, nachdem Sie dazu Ihre ausdrückliche Zustimmung gegeben haben und gleichzeitig Ihre Kenntnis davon bestätigt haben, dass Sie Ihr Widerrufsrecht bei vollständiger Vertragserfüllung durch uns verlieren.

8. Refunds

If a payment arrives after Bob has already died, or when no full minute can be credited, the payment is refunded automatically to the original payment method. Beyond that, and subject to section 7, purchases are not refundable.

9. Availability

We do not promise uninterrupted availability. The stream, the website and the payment provider can fail. If a technical fault on our side prevents the time from being credited after a successful payment, the payment is refunded. We are not liable for the consequences of an outage beyond that.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory statutory liability applies. For slight negligence we are liable only for breach of an essential contractual obligation, and only up to the foreseeable damage typical for this type of contract.

11. Age

By purchasing you confirm that you are at least 18 years old, or that you have the consent of a parent or guardian.

12. Applicable law

German law applies. If you are a consumer resident in the EU, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.

13. Changes

These terms may change. The version published at the time of your purchase applies to that purchase.
